I went bowling this afternoon with my uncle and his family. We completed just one frame before his shoe caught on a sticky patch of the floor, causing him to stumble onto the oil at the foul line and hit his head on the metal edge of the gutter. He’s awake and functional now, but he has a life-threatening brain bleed and he was unconscious for a couple minutes.
We found more than enough evidence to prove that this was due to negligence on the bowling alley’s part, but as soon as the paramedics took him out, the manager came and scrubbed up all of the oil and the sticky patch. Not only that, she only gave us a refund (not even an offer of an extra free round after we all watched a loved one nearly die) and never even expressed the slightest sympathy. Her first words to us were telling my cousin to get off the lane because she was smudging the oil. So, yeah. I think they’re going to primarily file a suit against her, rather than the whole company, to cover the medical bills. I also want to try to push for some sort of padding to be made mandatory on the first few feet of the gutters, considering he would be perfectly fine if he hadn’t landed directly on it. I’ll keep you guys updated on his condition and the legal situation in the next few days. Please keep my uncle in your thoughts and/or prayers, too. I’m sure he’ll be okay, but it’s still scary.

Not sure how fruitful or successful a lawsuit against the manager of a bowling alley would be.

I would recomend* not suing her and suing the bowling alley instead. While she reacted poorly, it is the bowling alley who is responsible, not her. It is the bowling ally who has liability insurance to cover this sort of incident.
On the padding, that is unlikely. he would have been fine if he hadn’t tripped in the first place. the sticky substance being there is negligence on the part of the bowling alley.
* I am not a lawyer, but my father is an insurance defense attourney and mainly works with the amusment industry. I have listened to him explain many cases involving bowling. I know this is does not give me a degree in law, but it does give me some very, very small frame of reference that not everybody has.

If people sued everytime they stepped on the oiled part of the lane and wiped out, there wouldn’t be any bowling alleys left. There are usually warnings signs in place to prevent this from happening.

I have bowled for basically my whole life. Sometimes the lanes are sticky. It happens. It sucks that someone was hurt, but a lawsuit seems exceptionally excessive.
I usually go up near the foul line and slide my foot to make sure it feels good before throwing the ball. I’m not saying everyone should do that, but in my experience sometimes the approach is sticky or slick. I don’t really think that’s negligence, shit happens.

Yeah, most alleys have “bowl at your own risk”,”not responsible for injuries” signage. Otherwise they’d be sued everytime a child gets their fingers smashed in the ball return. It’s an old industry, lawyers have perfected removing any type of liability.

This, this is what’s wrong with with this country. Everybody’s so damn sue-happy, nobody’s willing to take personal responsibility, it’s always somebody else’s fault. Why should it be anybody’s responsibility but your own that you don’t stub your toe?
Some slob that spills their soda thinks “it’s not my problem, somebody else wil clean it up”, now it’s the bowling ally’s fault you stepped in it? Give me a fucking break. If you fell through the floor, sure, that’s negligence. If somebody else spilled soda, no, you should have asked for it to be cleaned beforehand if that’s what you expected.
